Program Description:
The Amendment to FRCP 26(b)(2) instructs that a party need not provide electronically stored information from sources that are identified as "not reasonably accessible" because of undue burden or cost. This program will explore the convoluted meanings behind that innocent phrase.
Participants will explore:
- Examples of data that are not reasonably accessible.
- How to form a legal argument for inaccessible data.
- What you can do if the other side claims the information is inaccessible.
There appears to be a gap between the technical and legal definitions of inaccessible data. Technically, any data can be accessed as long as time and costs are no issue. But the amended rules recognize that there is a limit to what each side is required to do to retrieve old, legacy data. This session will explore how courts have ruled on the accessibility of ESI.

This session will explore the rules some States have put into place in regards to electronic discovery, as well as the relevant State caselaw.
